Bộ Công an Việt Nam đưa tin vào đêm 06/10/2020, công an thành phố Hà Nội đã tiến hành bắt giữ cô Phạm Đoan Trang tại căn nhà trọ của cô ở thành phố Hồ Chí Minh với cáo buộc “tuyên truyền chống nhà nước” theo Điều 88 của Bộ luật Hình sự 1999 và Điều 117 của Bộ luật Hình sự 2015.

Nhà hoạt động Phạm Đoan Trang là một trong những nhân vật hàng đầu cổ suý và đấu tranh ôn hoà cho nhân quyền, dân chủ và môi trường trong nhiều năm qua. Cô là một cây bút chính trị xuất sắc với nhiều tác phẩm như Chính trị Bình dân, Cẩm nang Nuôi tù, Phản kháng Phi bạo lực… và là biên tập viên nhiều websites có mục tiêu nâng cao dân trí như thevietnamese.org hoặc Luật Khoa tạp chí.

Cô đã nhiều lần tuyên bố rằng cô đấu tranh ôn hoà để xoá bỏ chế độ độc tài cộng sản ở Việt Nam.

Trong nhiều năm gần đây, cô Phạm Đoan Trang bị nhiều hình thức đàn áp của lực lượng an ninh Việt Nam, như bắt giữ để tra tấn, đánh đập đến mức tàn phế, và hạn chế quyền tự do đi lại… Cô buộc phải thay đổi chỗ ở hơn 50 lần trong ba năm qua để tránh sự truy bắt của an ninh cộng sản Việt Nam.

Trong vụ bắt giữ lần này, dường như cô sẽ bị biệt giam trong thời gian điều tra kéo dài ít nhất 4 tháng, không được gặp người thân và luật sư, giống như các nhà hoạt động khác bị bắt vì các cáo buộc thuộc phần An ninh Quốc gia của Bộ luật Hình sự.

Mạng lưới Nhân quyền Việt Nam và Người Bảo vệ Nhân quyền cho rằng cô Phạm Đoan Trang hoạt động ôn hoà, sử dụng ngòi bút của mình để đấu tranh cho dân chủ và nhân quyền. Cô chỉ thực thi các quyền được ghi trong Hiến Pháp Việt Nam và các công ước quốc tế về nhân quyền mà nhà cầm quyền cộng sản Việt Nam đã ký kết.

Do vậy, chúng tôi yêu cầu nhà cầm quyền Cộng sản Việt Nam

– Trả tự do ngay lập tức và vô điều kiện cho cô Phạm Đoan Trang và xoá bỏ mọi cáo buộc chống lại cô;

– Phải cho cô tiếp xúc với luật sư và thân nhân của mình, bảo đảm cô không bị tra tấn về thể chất và tinh thần cũng như bị đối xử vô nhân đạo trong khi bị giam giữ;

– Bảo đảm quyền tự do ngôn luận và các quyền con người cơ bản khác, thực thi các cam kết quốc tế về nhân quyền mà nhà cầm quyền cộng sản Việt Nam đã ký kết, và trả tự do cho các nhà hoạt động bị bắt giữ hoặc kết án vì các cáo buộc trong phần An ninh Quốc gia của Bộ luật Hình sự.

Chúng tôi kêu gọi toàn dân Việt Nam và cộng đồng quốc tế lên án việc nhà cầm quyền cộng sản Việt Nam đàn áp các nhà bất đồng chính kiến, người hoạt động xã hội và người bảo vệ nhân quyền, và đòi Hà Nội phải trả tự do cho họ ngay lập tức và vô điều kiện.

Joint Statement of Vietnam Human Rights Network and Defend the Defenders on Arrest of Activist Pham Doan Trang

Vietnam’s Ministry of Public Security has informed that in the late night of October 6, 2020, the Hanoi police arrested Ms. Pham Doan Trang at her rent apartment in Ho Chi Minh City on charges of “conducting anti-state propaganda” under Article 88 of Vietnam’s 1999 Penal Code and Article 117 of 2015 Criminal Code.

Activist Pham Doan Trang is one of the leading Vietnamese activists who have advocated and struggled for human rights, democracy, and the environment for many years. She is an excellent political writer with many works, such as Chính trị Bình dân (Politics for the Common People), Phản kháng Phi bạo lực (Non-violent Resistance), Politics of Police State, and Cẩm nang Nuôi tù (Handbook for Prisoners’ Families), etc. She is also an editor of several websites aimed at raising citizen awareness such as the vietnamese.org or the Vietnam Legal Initiatives.

She has repeatedly stated that she fights peacefully to abolish the communist dictatorship in Vietnam.

In recent years, Ms. Pham Doan Trang has been under various forms of repression by the Vietnamese security forces, such as arrest for torture, beatings to the point of disability, and restriction of freedom of movement, etc. She was forced to move from one place to another for more than 50 times in the past three years as the Vietnamese communist security forces are chasing her.

She will likely be held incommunicado for a period of at least 4 months of investigation, and she will not be permitted to meet with her relatives and lawyers, like other activists arrested on allegations in the National Security provisions of the Criminal Code.

Vietnam Human Rights Network and Defend the Defenders believe that Pham Doan Trang is a peaceful activist working to promote democracy and human rights in Vietnam. She only exercises the rights enshrined in Vietnam’s Constitution 2013 and international human rights treaties that the Vietnamese communist government has signed.

Therefore, we demand the Vietnamese communist authorities

– Immediately and unconditionally free Ms. Pham Doan Trang and drop all the charges against her;

– Permit her to contact her lawyers and relatives, ensuring she was not physically and mentally tortured and treated inhumanely while she is in police custody;

– Ensure freedom of speech and other basic human rights, implement international human rights commitments signed by the Vietnamese communist government, and release all the activists who are charged with or convicted of the controversial charges under the National Security provisions of the Criminal Code.

We call on the Vietnamese people and the international community to condemn the Vietnamese communist government’s repression of dissidents, social activists, and human rights defenders, and demand that Hanoi free them immediately and unconditionally.
