Tuyên bố của Mạng lưới Nhân quyền Việt Nam và Người Bảo vệ Nhân quyền về tù nhân lương tâm Trần Huỳnh Duy Thức

Tù nhân lương tâm Trần Huỳnh Duy Thức, người đang thụ án tù 16 năm tại Trại giam số 6 (huyện Thanh Chương, tỉnh Nghệ An) về tội danh nguỵ tạo “hoạt động nhằm lật đổ chính quyền nhân dân” theo Điều 79 của Bộ luật Hình sự 1999, đã tuyệt thực từ ngày 24/11 và ông tuyên bố sẽ tuyệt thực đến cùng cho đến khi Toà án Nhân dân Tối cao và các cơ quan của nhà cầm quyền cộng sản Việt Nam xem xét lại bản án của ông.

Năm 2018, Bộ luật Hình sự 2015 chính thức có hiệu lực, thay thế Bộ luật Hình sự 1999. Theo Điều 7 và Điều 109 của luật này thì tội danh “Người chuẩn bị phạm tội này [hoạt động nhằm lật đổ chính quyền nhân dân] thì bị phạt tù từ 01 năm đến 05 năm.” Đây chính là cơ sở để ông Trần Huỳnh Duy Thức có đơn kháng án từ tháng 7 năm 2018 yêu cầu nhà cầm quyền trả tự do cho ông sau khi ông đã thụ án liên tục từ năm 2010.

Mạng lưới Nhân quyền Việt Nam và Người Bảo vệ Nhân quyền nhận định rằng:

  1. Ông Trần Huỳnh Duy Thức hoàn toàn vô tội; các hoạt động của ông chỉ nhằm thực hiện các quyền cơ bản quy định trong các công ước quốc tế về nhân quyền mà nhà cầm quyền cộng sản Việt Nam đã ký kết và được Quốc hội Việt Nam phê chuẩn.
  2. Nhà cầm quyền cộng sản Việt Nam đã không tôn trọng Luật Nhân quyền quốc tế, Hiến Pháp 2013, và Bộ luật Hình sự 2015 mà họ đã ban hành.

Vì thế chúng tôi yêu cầu nhà cầm quyền cộng sản Việt Nam:

  1. Cứu xét kháng cáo của ông Trần Huỳnh Duy Thức ngay lập tức và thông báo để ông ngừng tuyệt thực nhằm bảo toàn tính mạng của chính mình.
  2. Trả tự do vô điều kiện cho ông Trần Huỳnh Duy Thức cũng như bồi thường cho ông về những năm tháng mà ông bị giam giữ từ năm 2018 tới nay.
  3. Cải thiện tình trạng giam giữ các tù nhân, đặc biệt các tù nhân lương tâm, theo tiêu chuẩn tối thiểu của Liên Hiệp quốc về giam giữ tù nhân (Quy tắc Nelson Mandela).
  4. Trả tự do cho tất cả tù nhân lương tâm, và bảo đảm người bảo vệ nhân quyền được hoạt động ôn hoà mà không bị giới hạn hoặc bị trả thù.

Mạng lưới Nhân quyền Việt Nam và Người Bảo vệ Nhân quyền kêu gọi các tổ chức và cá nhân trong nước cũng như cộng đồng quốc tế lên tiếng về trường hợp ông Trần Huỳnh Duy Thức và các tù nhân lương tâm khác để công lý được thực thi ở Việt Nam.

Statement of Vietnam Human Rights Network and Defend the Defenders on prisoner of conscience Tran Huynh Duy Thuc

Prisoner of conscience Tran Huynh Duy Thuc, who is serving a 16-year prison term at Prison camp No. 6 (Thanh Chuong district, Nghe An province) for fraudulent allegation “activities aimed at overthrowing the People’s administration” under Article 79 of Vietnam’s Penal Code 1999, has been conducting a hunger strike since November 24. Thuc declared to go on the hunger strike until the Supreme People’s Court and the government legal agencies reconsider his verdict.

In 2018, the Criminal Code 2015 officially took effect, replacing the Penal Code 1999. According to Articles 7 and Article 109 of the new code, the crime of “Preparing to commit this crime [activities to overthrow the human government people] shall be sentenced to between 01 and 05 years’ imprisonment.” This is the basis for Mr. Tran Huynh Duy Thuc to pursuit an appeal from July 2018 asking the authorities to release him after he has continuously served his sentence from 2010.

Vietnam Human Rights Network and Defend the Defenders declare that:

  1. Mr. Tran Huynh Duy Thuc is completely innocent; his activities were solely aimed at exercising his basic rights guaranteed by the international human rights conventions that the Vietnamese communist government has signed and ratified.
  2. The Vietnamese communist authorities did not respect the international human rights treaties, the country’s Constitution 2013, and the Criminal Code 2015.

So we request the Vietnamese communist regime to:

  1. Review Mr. Tran Huynh Duy Thuc’s appeal immediately and notify him to stop a hunger strike to save his own life.
  2. Release Mr. Tran Huynh Duy Thuc immediately and unconditionally as well as compensate him for the years he was held from 2018 up to now.
  3. Improve living conditions of detained prisoners, especially prisoners of conscience, according to the United Nations Standard Minimum Rules for the Treatment of Prisoners (Nelson Mandela Rules).
  4. Release all prisoners of conscience, and guarantee in all circumstances that all human rights defenders in Vietnam are able to carry out their legitimate human rights activities without fear of reprisals and free of all restrictions.

Vietnam Human Rights Network and Defend the Defenders call upon Vietnam’s civil society and individuals as well as the international community to speak up about the case of Mr. Tran Huynh Duy Thuc and other prisoners of conscience so that justice can be realized in Vietnam.
