Join us in calling for the immediate and unconditional release of human rights lawyer Nguyen Van Dai
Nguyen Van Dai is a renowned Vietnamese blogger, human rights lawyer, and democracy activist. On December 16th, he was detained by the Vietnamese authorities on charges of “spreading propaganda against the state.” His arrest came one day after the EU-Vietnam Human Rights dialogue which was held in Hanoi.
Nguyen Van Dai is a founder of the Vietnam Human Rights Centre and the Brotherhood for Democracy. He is a mentor to many Vietnamese activists and has conducted numerous trainings on civil and political rights. In early December, he was beaten by plainclothes police after speaking at a seminar in Nghe An Province before International Human Rights Day.
Nguyen Van Dai has not broken any Vietnamese or international laws. He should have never been arrested.
The United Nations Working Group on Arbitrary Detention has ruled on many occasions that Article 88 of the Vietnamese Penal Code (which forbids so-called anti-state propaganda) is in clear violation of both international law and the constitution of the Socialist Republic of Vietnam.
As a current member of the UN Human Rights Council, the government of Vietnam has a special responsibility to honor its human rights commitments. In addition, as Hanoi looks to join the Trans-Pacific Partnership (TPP), it must demonstrate that it respects rule of law and basic rights. The fact that Hanoi arbitrarily detained Nguyen Van Dai (along with a second activist, Le Thu Ha) immediately after the annual EU-Vietnam human rights dialogue is an affront to the international community.
We urge you to call for the immediate and unconditional release of Nguyen Van Dai. The Vietnamese authorities must provide restitution for arbitrarily detaining Nguyen Van Dai and must fully reinstate his civil rights including his freedom to travel and ability to practice law.

Nguyễn Văn Đài là một blogger, luật sư nhân quyền, nhà hoạt động dân chủ nổi tiếng. Vào ngày 16 tháng 12 năm 2015, ông bị chính quyền Việt Nam bắt giữ, với cáo buộc “tuyên truyền chống phá nhà nước”. Việc bắt giữ này xảy ra một ngày sau buổi đối thoại Nhân Quyền giữa Liên Hiệp Âu Châu và Việt Nam tại Hà Nội.
Luật sư Nguyễn Văn Đài là một sáng lập viên của Trung Tâm Nhân Quyền Việt Nam và Hội Anh Em Dân Chủ. Ông là người từng đồng hành với nhiều nhà hoạt động tại Việt Nam và đã hướng dẫn nhiều khóa huấn luyện về quyền chính trị và dân sự trong nước. Ngày 6/12/2015, ông bị nhiều công an giả dạng côn đồ hành hung thô bạo, sau khi thuyết trình trong một buổi sinh hoạt tại Nghệ An trước ngày Quốc Tế Nhân Quyền.
Luật sư Nguyễn Văn Đài không vi phạm bất cứ luật lệ nào của Việt Nam hay quốc tế. Ông không thể bị bắt giữ.
Ủy Ban Điều Tra về Bắt Giữ Tùy Tiện của Liên Hiệp Quốc đã ra phán quyết nhiều lần là Điều 88 của bộ luật Hình Sự Việt Nam (cấm tuyên truyền chống nhà nước) đã vi phạm rõ rệt luật pháp quốc tế và hiến pháp của Cộng Hòa Xã Hội Chủ Nghĩa Việt Nam.
Với vai trò thành viên hiện thời của Hội Đồng Nhân Quyền Liên Hiệp Quốc, chính quyền Việt Nam có trách nhiệm đặc biệt phải tôn trọng các cam kết nhân quyền của họ. Ngoài ra, trong lúc Hà Nội mong đợi tham gia vào Hiệp định Đối tác xuyên Thái Bình Dương – TPP, họ phải chứng minh cho thấy sự tôn trọng pháp luật và các quyền căn bản của con người. Sự kiện Hà Nội bắt giữ tùy tiện luật sư Nguyễn Văn Đài (cùng với một nhà hoạt động khác, cô Lê Thu Hà) vừa ngay sau buổi đối thoại nhân quyền hàng năm giữa khối Liên Âu và Việt Nam cho thấy sự bất chấp trắng trợn đối với cộng đồng quốc tế.
Chúng tôi khẩn thiết kêu gọi quý vị lên tiếng đòi trả tự do ngay lập tức và vô điều kiện cho luật sư Nguyễn Văn Đài. Nhà cầm quyền Việt Nam phải bồi thường cho việc bắt giữ tùy tiện Nguyễn Văn Đài và phải phục hồi hoàn toàn các quyền dân sự cho ông kể cả sự tự do đi lại và quyền hành nghề luật sư.
